Overview — applicability and scope

These legal terms apply to Choicewave (ABN: 12 345 678 901), its website choicewave.info and any services or content we provide in Australia. They describe rights and obligations for consumers and business users as required by Australian law, including the Australian Consumer Law (ACL).

Australian Consumer Law (ACL) — your statutory rights

The ACL provides consumers with guarantees including that goods are of acceptable quality, fit for purpose and match descriptions. These statutory rights cannot be excluded. Our commercial warranties sit alongside, not instead of, ACL guarantees.

RightExamples
Acceptable qualityFree of defects, safe, durable
Fit for purposeWorks as expected for advertised use
Match descriptionMatches photos, specs and features

If you believe a product breaches the ACL, you are entitled to a remedy such as repair, replacement or refund depending on the circumstances.

Returns, refunds and faulty goods

Choicewave assesses returns case-by-case consistent with ACL. For faulty products we will offer repair, replacement or refund. For change-of-mind purchases (non-faulty) returns are at our discretion and may incur postage or restocking fees.

  • Report faults within a reasonable time via Contacts.
  • Keep purchase proof (order number, receipt) to help processing.
  • Products returned without faults may be refused or charged.

Warranties & liability

We provide manufacturer or vendor warranties where listed. To the extent permitted by law, Choicewave's liability for loss or damage is limited to resupplying the product or refunding the purchase price. We are not liable for indirect or consequential loss.

For clarity, these terms do not affect non-excludable rights under Australian law. For business users, certain ACL protections may be limited by agreement where permitted.

If you have a privacy concern or access request, contact our Privacy Officer via Contacts. We aim to respond promptly as required by law.

Dispute resolution & consumer help

We encourage customers to contact us first to resolve issues. If matters cannot be resolved, consumers may seek assistance from:

  • Australian Competition & Consumer Commission (ACCC)
  • State/Territory consumer affairs agencies
  • Small claims tribunals or courts

Report faults as soon as practicable. ACL does not prescribe a single period; it depends on product type and expected lifespan.

Change-of-mind refunds are discretionary. Contact us and we will outline options which may include store credit or exchange.

Updates, notices and jurisdiction

We may update these legal terms. Notices will be posted on this page. These terms are governed by the laws of the Commonwealth of Australia and the state of Victoria where applicable.
